Assault on a Police Officer

My client was charged with an assault, which was threatened by the prosecution to be elevated to a felony assault on a police officer. It was the prosecution's belief and the off-duty officer's statement that he knew he was a police officer. Instead of the elevated offense to a felony, it was negotiated that the prosecution would offer a Misdemeanor of the 4 ^th Degree Disorderly Conduct.
